The United States District Court for the District of Oregon was formed in 1859 when the state of Oregon was admitted to the union. The jurisdiction of this Federal Court consists of the state of Oregon. Post 1859, when Oregon became a state, the United State Congress created the district of Oregon on March 3, 1859. Except patent claims and claims against the United States government under the Tucker Act, cases from the district Court of Oregon are directed to the United States Court of Appeals for the Ninth Circuit. The current United States Attorney is Karin J. Immergut, whose office represents the United States in litigations in court. Till 1998, the district courts had a separate existence but in 1998 the district courts merged with the circuit courts.
The state comprises of 27 judicial districts. The number of judges appointed in each district is decided by the state. There are four divisions of the offices in four locations: Portland, Eugene, Medford and Pendleton. The circuit courts are the official trial courts for t he state of Oregon. The circuit courts have general jurisdiction over all civil and criminal cases. The cases that are beyond the scope of the other courts are usually handled in the circuit courts. There are specialized divisions of the court to deal with different types of cases- Juvenile Court, Family Court, Criminal Court, Commercial Court and Drug Court. Felony, preliminary hearings, capital murder are a few of the criminal cases heard here.
The civil cases include monetary claims without any limit, small claim cases, civil equity, complex commercial, administrative agency appeals, real estate title and boundary. Commercial cases are related to the internal and external affairs of a trade, construction defects, insurances etc. They also handle relationship cases like divorces, child custody and visitation, child support, paternity, domestic violence and protection order. Juvenile cases like adoptions, juvenile delinquencies, child abuse and neglect, termination of parental rights, children in need of supervision are always heard in the circuit courts. Mental health cases like involuntary commitments and probate matters like wills and estates, name change, trusts and guardians and conservatorships are also heard in the Oregon district cases. A small claims court division hears civil cases for recovery of money, damages or personal property. The limit in this case is less than $5000.for claims less than $750, the cases are heard only in the small claims division.
