Delaware County Court Records

The mission of the legal division of clerk of Delaware County is to maintain the courts' records correctly and timely and to provide prompt, accurate and courteous customer service. The records maintained by the Delaware County Court and the ability to access them are a means to provide trust between the public and Delaware County. To foster, maintain and continue to build such trust, the Court and Delaware County, in accordance with state law, adopts this Court Records Policy.

Delaware County Court Records and documents of case files along with the relevant information are thus available in the office of the clerk and also through the Internet. Every attempt is made to provide accurate and current information. The new online case enquiry system, known as Courtview, maintains digital records of most court documents and searches monies beginning from April 27, 2005. Thus any court documents after this date is reflected in the online system prior to which cases can only be obtained by contacting the clerk?s office.

By Delaware county courts laws, court "records" include all legal document, device, or item, regardless of physical form or characteristic, including an electronic record as defined in section 1306.01 of the Revised Code, which serves to document the judicial organization, functions, policies, decisions, procedures, operations, or other activities of the office.

In respect to voluminous request, only limited request of ten case files per month is allowed upon the discretion of the custodian would be entertained, unless the requestor certifies that the records or information in them will not be used for commercial purposes. The denial of request is possible if the requestor is unable to provide suitable reasons for the access of records but should be done with proper explanation, including legal authority.
